Terms of Sale and Use

These terms are between you and NimbleBit LLC (“we”, “us”). They cover playing, and buying things in, the games NimbleBit hosts on the web, in your browser or from your home screen, at nimblebit.com and its subdomains. Today they are:

• Tiny Golf at golf.nimblebit.com
• Wings: Butterfly Garden at wings.nimblebit.com
• Pocket Pilots at pilots.nimblebit.com

They also cover any web game we add to nimblebit.com/web. By playing or buying, you agree to them. A game’s own terms, such as the Pocket Pilots terms, add to these for that game. Our privacy policy says what we keep about you. Our apps on the App Store and Google Play have their own terms there.

Who can buy

You must be 13 or older to play Pocket Pilots, and old enough where you live to make purchases. If you are under 18, ask a parent or guardian before buying anything.

What you buy

• Items, unlocks and in-game currency, such as Pocket Pilots’ jumps, liveries and Pilots Club, Tiny Golf’s drinks (which unlock outfits and cloud sync), and Wings’ tips (which make you a Wings Supporter).
• They are a license to use them in that game. They have no cash value, can’t be sold, traded or moved to another game, and may be rebalanced as the game changes.
• They are delivered to your game at once. Keep your sync code or receipt: we use it to restore a purchase in another browser or on another device.

Paying

You pay through Stripe’s checkout. In Pocket Pilots and Tiny Golf, purchases are sold through Link, Stripe’s checkout, and Link’s terms apply as well as these; in Wings, we sell the tip and Stripe processes the payment. The price, including any tax, is shown before you pay.

Subscriptions

A subscription, such as the Pilots Club, renews automatically every period at the price shown until you cancel. Cancel at any time from the game or at link.com. It stays on until the end of the period you have paid for. If the price changes, we’ll tell you before it applies to you.

Refunds

For a refund, contact Link’s support for a purchase sold through Link, or us at support@nimblebit.com. We follow the law where you live. If a purchase is refunded or charged back, what it gave may be removed from your game.

Playing fair

• Don’t use bots, scripts or automation, exploit bugs, make extra accounts to farm rewards, or interfere with the games’ servers or other players.
• Names and anything else you share with other players must not be offensive, hateful, sexual, impersonate someone, or be something you don’t have the right to share. You keep what’s yours in them, and give us permission to show them in the game.
• We may rename or remove what breaks these rules, and reset, suspend or delete accounts that do, taking back what was gained. Where purchases are lost this way, they aren’t refunded unless the law requires it.

The games

Our web games are online services, and we keep changing them: features, prices, balance and rules may change, and beta versions may be reset. Your progress lives in your browser unless a game keeps it on our servers, so clearing your browser’s site data can erase it. We work to keep the games running, but they are provided as they are, without guarantees that they will always be available or free of bugs. If we ever close a game, we’ll give notice in the game first and stop selling in it.

To the extent the law allows, we aren’t liable for indirect or consequential losses, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing in these terms takes away rights you have as a consumer under the law where you live.

Changes, law and contact

If these terms change, we’ll update this page and its date, and mention important changes in the games. These terms are governed by the laws of California, USA, except where the law where you live gives you rights that can’t be changed by agreement. Questions: support@nimblebit.com.
